Dave Guardala NEWS - Guardala UPDATE

It's official - Dave Guardala Pleaded NOT GUILTY to charges today in Federal Court in New York according to Randy Kessler, writer for NewsDay.com.

According to the article, Dave Guardala was at arraignment proceedings this morning to hear 10 counts of alleged fraud read against him with federal public defender Randi Chavis by his side. The Judge in this case is listed as U.S. Magistrate Arlene Lindsey, and proceedings were held at United States District Court, Eastern District of New York.

On the court schedule, Senior Judge Thomas Platt was scheduled in Courtroom 1040 at 11AM Eastern, for Criminal Cause for Arraignment, but it appears from this article by Kessler that the Judge today was U.S. Magistrate Arlene Lindsey.

Other interesting note was the last line of the article. To this date, little has been said or projected about a possible sentence in this case if Guardala is found guilty. Kessler's closing statement was Dave Guardala could get up to 30 years in prison if convicted.

With the exception of one brief phone conversation with Greg to verify the legitimacy of the people who were contacting me. I was told that I was one of the last victims Guardala was in contact with and was to try and keep up communications with him as long as possible. I do not know if it helped them catch him but I am very happy he was caught, was brought back to the U.S. and is being held without bail.

      My story is virtually identical to Greg's. Almost word for word with the exception of a few instruments that Guardala tailored to fit the lives of me and my wife who is also a musician and repair technician. I hope anyone victimized by this whole situation is able to come out on top. It will be a long road for many of us. In an attempt to recover our losses I have thought of selling my Guardala tenor. Although after watching their prices drop over the last few years I do not think it would be worth it, and I'm sure this publicity will not help the value of his products. It is still one of the best saxes I have ever played and will keep it.

      I thank everyone who talked to and worked with investigators. You all deserve more than this whole mess. Greg, thanks for all of your time and hard work. You were instrumental in rallying everyone and getting this guy behind bars! If at all possible I will be in New York when he comes to trial.

        Thanks for posting. I know it is hard to talk about this stuff because it hit you (and many of us) really hard. I so wish we were all sitting around pissed off at Dave for making mouthpieces so good that we ended up paying way too much for them.

        Instead, we got the rare opportunity to have Dave Guardala lie and steal hard earned money from us, our businesses and or families.

        But, thank God, that was not the end of the story. In today's world, a few guys can work together, use this internet thing, and make a difference.

        I wish so many guys hadn't been hurt by these scams, but I am really glad it wasn't another 50 or 100 people down the road before someone said, "ENOUGH!"
