Dave Guardala back in Court??


Well, it would appear that the court date for Dave Guardala did happen after all. I was told by email that Guardala would be in court on March 28th, but then heard from a friend that there was nothing posted on the court calendar for Guardala on the 28th.

Now, I just received email that a post on Sax On The Web states - "What has become of Dave Guardala? - Saw D.G. 3/28 in an "orange jumpsuit". Head was down most of the time. Next Court hearing is 4/11/08, 9:30AM Federal Court Building, Central Islip, N.Y. 10th Floor. Hon. Thomas Platt"

The poster is a new name so was intended to be anonymous it would appear.

As always, I will post anything I hear so all the latest news should be up as soon as it comes in.

I did talk to 2 other victims and they had nothing more to add - had heard nothing. I would assume Monday or Tuesday should bring an update from the investigation. What a fall from most envied and hated Mouthpiece Kingpin in the world to most broken and hated convict in the Music World. I would feel sorry for him if he had not gone out of his way to do this to himself. At this point it is just pity. How sad a day we live in.

      Several of us regular visitors to Judge Platt’s courtroom this morning witnessed Guardala ask for yet another delay in the proceedings. Even his attorney looked bewildered at this decision. Owing to the acoustics of the courtroom, it was difficult to hear what was being said up in the front. But we could tell that the judge was not pleased, as he insisted that the proceedings continue on Wednesday 4/16. DG will be expected to plead guilty or not guilty. If not guilty, then a trial date will be set.

      In the meantime, I would urge everyone to write Judge Platt and briefly outline their relationship with Guardala, the amount of money lost, including opportunity cost, and personal hardships suffered as a result. Since we all cant be in the courtroom, this kind of support may affect the judge’s decision to sentence. Please make your writings polite, truthful, and to the point. The judge is definitely a no-nonsense guy.

      From my standpoint, if Guardala has any assets stashed away in foreign countries and gets a short jail term, all of this justice will be for naught if he is able to serve the time and get released at a young enough age to enjoy OUR MONEY. We need to lobby the judge either for restitution (which may be very difficult) or a very punitive sentence.

      My motto: Money, revenge, or justice, in that order.
      We already know we’ve got the justice. If we can’t get the money, he should rot in Federal Prison for as long as the law will allow.
