Have not heard a thing from anyone in NY since I was notified that the trial was adjourned for 30 days. (Due to start October 10, 2008) I wish he would change his plea to guilty and save everyone a whole lot of hassle!!
      I'm frustrated too!

saxtek is right. the last docket entry reads
"Minute Entry for proceedings held before Senior Judge Thomas C. Platt: Status Conference as to David Steven Guardala held on 9/15/2008. Deft present in custody with federal defender Randi Chavis. Government: AUSA Richard Lunger. Conference held. Deft makes a motion for change of counsel and an adjournment of the trial. The deft has written to numerous attorneys to ask for pro bono representation and has just started to receive responses. The court will not appoint new counsel and the deft cannot retain new counsel. The Government opposes any request for adjournment. The Court grants the deft a 30 day adjournment. Set conference for 10/10/08 at 9:30 a.m.. Order of excludable delay entered on the record. The Court finds that failing to grant the deft's motion for an adjournment would deny the deft reasonable time to try toobtain pro bono counsel, which may result in a miscarriage of justice. The adjournment is in the best interests of the public since the deft is incarcerated. (Court Reporter Stephanie Picozzi.) (Glueckert, Lisa) (Entered: 09/16/2008)"
