When Dave gets out, what is to prevent us from suing him in civil court?

Perhaps it will be like getter blood from a rock, but it must have occurred to some of us and Dave as well.

Sorry to hear that the sentencing did not go as expected. Very talented people like Dave often do bad things that started out as good intentions. I am luck enough to have one of his gold plated prototypes from the B&S factory in Germany. I really don't play it that often anymore since I am a scientist and no longer a professional musician. The stigma attached to the Guardala saxes probably keeps me from playing it and if I could find someone to buy it from me or take in on trade for something else I would do it. I agree, 48 months with 24 time served is a very poor commentary our judicial system. On a completely different subject, could you recommend a good sopranino? I am about to head to Central Asia on a special DoD assignment for the next two years and don't want to take my alto (I need to travel light). I was thinking about perhaps even a curved sop.

Congrats to Dave Guardala's Lawyer

He played the Federal Attorney and Judge for fools.

He takes a case that an incompetent predecessor could not handle and agrees to have his client plead to 57 months, down from 30 years and promises to have his client repay the million he stole that is the subject of the indictment.

The probation report comes back that he can't possibly pay restitution i.e the Lawyer was lying to the court. So what does the client get in return--much less than he agreed to.

This case should never have been opened to pleas. The evidence is reported to be overwhelming. But when you have a Federal Attorney and A Judge who would rather not do their jobs and try this case, this is the injustice that happens and why the legal profession is hated.

Dave Guardala's victims are victims once more.

Could Dave have made a million (forgetting the other few million he stole that he was not indicted for, in 48 months, honestly?

Good investment, Guardala-you win.. Nice going, since you can't afford the even better return of a campaign contribution

Dave's victims deserved better.

Glad to hear you're in a better place now. I think anyone involved with this case has understood your passionate voicing of concerns and feelings regarding the man and the case.

At times they seemed a bit strong but I think that you were putting down what many of us were feeling. Thanks for putting it all out there! I'm sure reading what many were feeling helped those people deal with it all a little better.

I know some of us were hit harder financially than others. Hopefully everyone has or is moving past the situation. We are all waiting for the sentencing. I understood that it would be by February or March but I have not called NY to check with the officials either.

Everyone who is involved with this case or not, no matter what side of the fence you are on, has to remember that this shouldn't break anyone's spirit. Life will go on and it is up to us to live life to its fullest.

wow.....just been listening to a guardala mouthpiece on almartino capri site,did a seach to to find out how much it cost and ended up on this can of worms.im only a beginner in the sax playing department but this kind of thing puts me off buying anything from a manufacturer direct.for professional players i think this kind of thing can hurt the legitamate manufacurer to the point of no one realy being able to trust any-one.he makes a good piece,its a shame that honest people that are making a life and living playing music have to suffer at the hands of this kind of scumm.music is for the people and prison is for shite.i would love to be able to play to a level where i could respect a man for producing a sax mouth-piece like this but i for one would rather play another mouthpiece than be helping this man gain a rep that is not deserved at a human being level.live the music ,feel the power,sax is for the soul,prison is for scumm.i could not blow a guardala knowing this....jim

My two cents..

I am glad to see Guardala finally get his day in court and it looks like justice is done. That said life is to short my man and if I were you I would move on. From here it looks as if this thing is eating you alive. I know you by reputation as a great guy and a man of faith not to mention a hell of a horn player. Life isn't fare that's for sure and I too have been dealt my share of bad hands. there comes a time when you call it quits, get up from the table and move on. Is Dave a piece of human garbage? of course but don't get sucked into his trail of debree.

Life isn't about being knocked down, it's about how fast you get back up.
