Very talented people like Dave often do bad things that started out as good intentions.  I am luck enough to have one of his gold plated prototypes from the B&amp;S factory in Germany.  I really don't play it that often anymore since I am a scientist and no longer a professional musician.  The stigma attached to the Guardala saxes probably keeps me from playing it and if I could find someone to buy it from me or take in on trade for something else I would do it.  I agree, 48 months with 24 time served is a very poor commentary our judicial system.  On a completely different subject, could you recommend a good sopranino?  I am about to head to Central Asia on a special DoD assignment for the next two years and don't want to take my alto (I need to travel light). So what does the client get in return--much less than he agreed to.&lt;br /&gt;&lt;br /&gt;This case should never have been opened to pleas. The evidence is reported to be overwhelming. But when you have a Federal Attorney and  A Judge who would rather not do their jobs and try this case, this is the injustice that happens and why the legal profession is hated.&lt;br /&gt;&lt;br /&gt;Dave Guardala's victims are victims once more.&lt;br /&gt;&lt;br /&gt;Could Dave have made a million (forgetting the other few million he stole that he was not indicted for, in 48 months, honestly?&lt;br /&gt;&lt;br /&gt;Good investment, Guardala-you win.. I think anyone involved with this case has understood your passionate voicing of concerns and feelings regarding the man and the case.&lt;br /&gt;&lt;br /&gt;At times they seemed a bit strong but I think that you were putting down what many of us were feeling.  Thanks for putting it all out there!  I'm sure reading what many were feeling helped those people deal with it all a little better.&lt;br /&gt;&lt;br /&gt;I know some of us were hit harder financially than others. Hopefully everyone has or is moving past the situation.  We are all waiting for the sentencing.  I understood that it would be by February or March but I have not called NY to check with the officials either.&lt;br /&gt;&lt;br /&gt;Everyone who is involved with this case or not, no matter what side of the fence you are on, has to remember that this shouldn't break anyone's spirit. That said life is to short my man and if I were you I would move on. From here it looks as if this thing is eating you alive. I know you by reputation as a great guy and a man of faith not to mention a hell of a horn player. Life isn't fare that's for sure and I too have been dealt my share of bad hands. there comes a time when you call it quits, get up from the table and move on.
