Guardala October 10 Court Date

According to Court documents forwarded to me this morning, our dear friend Dave Guardala was in court at 9:30 AM in New York. Dave Guardala was scheduled to begin trial today on fraud charges - a 12 count Federal indictment that was supposed to be starting today.

The documents forwarded state that Guardala did see the Judge today, but give no further detail.

At last update by prosecutors, Guardala was working on finding a free Attorney and was granted an 30 day extension to try. Guardala has been in custody for over a year now. Does anyone know what happened to day in court? I wouldn't even know he had seen the Judge if I didn't have people following this case, sending me these documents.

Dave Guardala sold me a bunch of saxophones that never existed - stated fact.
Dave Guardala duplicated a scam to defraud every saxophone player and music business person he could - alleged.
Dave Guardala found many victims willing to invest and never delivered anything promised - alleged.
Dave Guardala is in Jail in Islip New York, and continues to put off the inevitable - hearing to face charges - 12 count Federal Indictment - known fact.
Dave Guardala managed to get more time and proceedings are pending for October 2008 - known fact.
Dave Guardala is going to trial this month? UNKNOWN.

Dave has successfully pushed this trial back, having been placed in custody a year ago in the US.

I have had many forward court papers and documents over the course of these proceedings.

Does anyone know if the trial is going forward this month as last stated by the court??

September 15th Court date is pushed back a month

The scheduled September 15th trial start was pushed back 30 days. I got the calls this morning. The trial was scheduled to start Monday, but will be postponed for a bit.

Well, as of August of 2008 there is little question that the real Dave Guardala did really go to the dark side and defraud dozens of individuals and businesses of 100's of thousands of dollars. I do still get the occasional email from a well meaning individual living in disbelief that Dave Guardala could do such a thing though.

To the few that don't believe the story and still maintain that the ability to create a great product precludes any ability to be evil, I have one thing to say. These are not mutually inclusive factors. Bad people can do good and good people can do bad. Just because an individual excells at making a great thing, product or venture or whatever; it does not mean they are good. SO often, we have problems separating the person from the event. I don't know how or why Dave Guardala went evil on the sax world. All I know is that he did. I have personal involvement and have meet many other respected individuals thru these events that share the same story.

Yes, the real Dave Guardala did bad stuff. He is in jail and will be facing charges that he did bad stuff. If the facts are accurate (as I believe they are), Dave Guardala will have an extended stay at a prison here in the US. I don't claim to understand the legal process or the court system at all. I do claim to be a victim of Dave's stupidity and have hopes that his last year in jail in New York will be extended for many years in the prison system.

Sorry for feeling the need to go there again, but sometimes the email can be a bit frustrating.

On another note - Does anyone know what is going on with the September court date??

I was contacted, interviewed and know nothing more. Any of the other victims out there with any update? Any of the local New York guys dealing with investigators know anything new? Is the court date proceeding - September 15th??

I would love to hear from anyone in the know with a little update. Sometimes being on the West Coast, far from the action, feels like I am very out of the loop.

Appreciate any word on this...

WOW - I am so surprised to get the most recent comment I just got under 'What Does Dave Guardala Look Like?'

Another kind hearted soul questions the possibility of Dave Guardala being able to do such a thing.

I said it there and now say it here.

Please do not confuse Gift and Talent with moral good or Character. I know I did. I saw the gift and believed the person. These 2 areas of human expression can be completely unrelated! A gift does not imply a good person. Bad people can have great gifts but lack the common sense to grow within the gift.

Well, even though I can't believe it, this case seems to be headed towards wasting the government's money (which is the tax payers money - which is our money!) and is going to trial. I thought for a while that this was a ploy of some sort to attempt to look like a good guy in the 11th hour and not go to trial with a healthy plea bargain following.

All the email and court papers I have seen seems to be making a case for Dave's continued lack of any judgment or intelligence of any kind. It would appear that Guardala has been complaining about his counsel, and wanted a new public defender which was denied by the Judge. From what has been going on, it seems Dave thinks he should get off and believes he can. This is amazing!

If anyone knows how wrong he is, it should be him, He was there, doing the deed, and ripping everyone off. He knows he is a lowlife thief that preyed on sax players and then on others, once he had his 'evil chops' better fine tuned. I hope Dave gets 100 years in jail at this point. Of course he wont. But, what a dick...

So, I have a scheduled conference call Thursday with investigators and will find out at that time, what involvement I might have in the case. I know we have 100's of documents and hours of taped conversations and dozens of victims that had no doubt they were dealing with Dave Guardala. I think reality for Dave is still something that needs a minor adjustment.

SO, for those of you asking for an update - that's it. It is going to trial. Dave could be defending himself. Dave is going to jail for at least a few years. The trial is to begin September 15th I believe.

This would be another site online that truth looks much stranger than fiction...

Hey, Dave. If you have computer access there in jail - YOU SUCK!

Guardala Court Day June 6th UPDATE

Dave Guardala Update 6.7.08

Dave Guardala was in court again yesterday and I did get an email with the days notes. It was not very good news since many of us just want him to go away to prison and and be done with it. Of course we all want our money back but we also want fairies to come and give us uncountable riches too.

Conference held. . No plea has been reached. The Court will set a trial date. The defense counsel is on
trial until the end of June. 20 potential witnesses need to be prepared many from out of state and some from
Germany; multiple tapes and documents need to be copied. The parties agree they need about 8 weeks to prepare
for trial and have previously arranged travel plans in August. The trial will last 5 weeks. Based on the arguments
presented by counsel the Court will set a trial date of 9/15/08 at 9:30 a.m.. Order of excludable delay entered
based on complexity of the case. To ensure that the time is still needed the Court will set a set status conference
for 7/11/08 at 9:30am..

I guess he is working the process best he can.

Another Day and another scheduled

Hello Guardala Scam followers. The story continues again with another court date scheduled for June 6th. This is what I have -

The following transpired at Guardala's
court conference this morning before Judge Platt. Guardala's attorney
informed the judge that she needs more time before she can allow her
client to either plead guilty or proceed to trial.

She claims to need the time to have some documents that were found in
Guardala's luggage translated from German into English. It was also
announced in court that the government has recently identified
additional victims in this case by reviewing other documents found in
Guardala's luggage.

At least 5 victims were present in court today despite incredibly
inclement weather. I am impressed by the commitment that all of the
victims have shown throughout this matter. I hope that we will have a
definitive direction in which to go after the next court date; June 6, 2008.

Dave Guardala is a bad person and did very bad things to toooooo many people! SO, I was right in yesterday's post. We await another court date and my attempted, self imposed, reverse psychology did not work. Nothing today and another month to find out what these documents say and who these new victims are. Bad Dave!

My last post said "Waiting for the next Court date - May 9th" Well, it is officially May 9th on the east coast and the court calendar reads -

I would have thought this was going to be the big day, but time and posts below would indicate this will be a day, just like all the other days Dave Guardala has been in court, but don't expect any real news. This has been going on for some time and continues again today. (Of course, since I said that, the sh*t will hit the fan with news

Any of you east coast guys that get to the court house, drop a line so we can find out what happened with the latest information that caused this last delay. I appreciate it! Being on the west coast, I really do appreciate you-all taking a minute to keep all of us up to date on the proceedings.

Waiting for May Court Date...

>As we wait for new evidence to the Guardala scam and fraud case, I have been getting lots of email and felt the need to do a quick update.

Today I received court documents, via email, covering the Guardala Indictment, Warrant for his arrest, unsealing of the court records once he was in custody, and records of the last date in court to this point.

The delay issued was very odd and left everyone a bit surprised. The notes from the court records add little to the answers other than better explaining the cause of the last delay. The notes read as follows -

Conference held. Parties request additional time to negotiate a plea agreement and new evidence was received from the defendant's German residence that both the Government and Defense Counsel wish to review. Order of excludable delay entered. Set status conference for 5/9/08 at 9:30am.

That's all I got other than more detail on the other victims which are not named, but will stay off the blog out of respect to their personal lives and business lives.

Court Day for Guardala April 16

Today was another day in court for Dave Guardala. All thoughts were on a plea from Mr Guardala but thing did not go as expected.

The last post explained the judge did not seem real happy about the delays and today was going to be it. Even the court calendar suggested today would be different. From what I understand, Some issue over Guardala's belongings was viewed as new information that the prosecution needed time to assess. I have no idea what this is about. Another person used the term personal items.

This all being roughly hearsay, the real issue was another delay and no plea today.

Dave Guardala is now scheduled to be back in court on May 9th.

Pretty amazing how he can drag this out beyond any possible expectation.

So back to jail till the 9th. We will report any information we get.

If anyone can add anything to this much of the story, please post or email me.

Dave Guardala was in court again today, and all expectations were a plea, most likely of guilty, so I thought. Well, we heard no plea other than for more time by Dave Guardala himself. I was not in the court room but I did just receive a post/comment by someone who was. Just so this information is not buried on a comment page but very visible, I am posting it right here for you to read.

Several of us regular visitors to Judge Platt’s courtroom this morning witnessed Guardala ask for yet another delay in the proceedings. Even his attorney looked bewildered at this decision. Owing to the acoustics of the courtroom, it was difficult to hear what was being said up in the front. But we could tell that the judge was not pleased, as he insisted that the proceedings continue on Wednesday 4/16. DG will be expected to plead guilty or not guilty. If not guilty, then a trial date will be set.
We’ll be there again.

In the meantime, I would urge everyone to write Judge Platt and briefly outline their relationship with Guardala, the amount of money lost, including opportunity cost, and personal hardships suffered as a result. Since we all cant be in the courtroom, this kind of support may affect the judge’s decision to sentence. Please make your writings polite, truthful, and to the point. The judge is definitely a no-nonsense guy.

From my standpoint, if Guardala has any assets stashed away in foreign countries and gets a short jail term, all of this justice will be for naught if he is able to serve the time and get released at a young enough age to enjoy OUR MONEY. We need to lobby the judge either for restitution (which may be very difficult) or a very punitive sentence.

My motto: Money, revenge, or justice, in that order.
We already know we’ve got the justice. If we can’t get the money, he should rot in Federal Prison for as long as the law will allow.

March 28th Court Date

Dave Guardala back in Court??

Well, it would appear that the court date for Dave Guardala did happen after all. I was told by email that Guardala would be in court on March 28th, but then heard from a friend that there was nothing posted on the court calendar for Guardala on the 28th.

Now, I just received email that a post on Sax On The Web states - "What has become of Dave Guardala? - Saw D.G. 3/28 in an "orange jumpsuit". Head was down most of the time. Next Court hearing is 4/11/08, 9:30AM Federal Court Building, Central Islip, N.Y. 10th Floor. Hon. Thomas Platt"

The poster is a new name so was intended to be anonymous it would appear.

As always, I will post anything I hear so all the latest news should be up as soon as it comes in.

I did talk to 2 other victims and they had nothing more to add - had heard nothing. I would assume Monday or Tuesday should bring an update from the investigation. What a fall from most envied and hated Mouthpiece Kingpin in the world to most broken and hated convict in the Music World. I would feel sorry for him if he had not gone out of his way to do this to himself. At this point it is just pity. How sad a day we live in.

Dave Guardala's next court date

Sorry for not posting much as of late but there has been nothing to post as Dave is still being held with no bail, in jail in New York.

His next court date will be March 28th and I would not be surprised if he enters a guilty plea on that day. As a victim myself, I know he is guilty because he ripped me off. I have also talked to all the other victims over the course of the past year and a half and believe they were also ripped off by Guardala's Scams.

So, we will see what happens on the 28th. If he pleads guilty, the next faze is sentencing, which should take place over the following month or 2.

Next Court Date

Revised and Updated - 2.14.08 (for Valentines Day)

Since Guardala missed the last court date due to transportation screw-ups, the question has been - What's Next??

It appears Guardala has waved his rights to a speedy trial, meaning he does not mind sitting in jail too much. From what I have been told, Dave Guardala is scheduled to be back in court on March 28th for a court conference. Guardala's first court date in February was postponed, but he did appear the following week without much fanfare. This delay is WITH Guardala's consent. This hearing is designed for both sides to communicate to the judge the status of the case in their respective opinions.

So we wait for the 28th of March, wondering what it might bring. Wish there was something more concrete to report, but that's it for now.

Dave Guardala back in Court

Dave Guardala should be back in court February 1st according to the court calendar just received. It is expected that Dave will most likely plea guilty at this time due to the overwhelming case the Federal Government has against him. Of course he could try and fight it but none of us have any idea what the grounds for this might be.

February 1st should tell where this is headed either way. A Guilty plea could save him some time in prison since it would not make him look as much like the creep he is. Having a dozen victims with serious loss attributed to his actions could tighten the noose around his little neck even more.

I am told we have the right to enter statements for use in the sentencing stage. Hardship, loss and personal notes relating to Guardala are to be considered in the sentencing by the Judge if the case does not go to trial. A Guilty plea would send the case straight to sentencing and avoid a trial. If it goes to trial, I will be there to testify and do whatever I can to make sure Dave Guardala spends the maximum time in prison possible.

I was surprised by the "NOT GUILTY" plea at Dave's first court appearance, but later discovered this was to be expected. Guardala had met his Public Defender 20 minutes prior to standing before a judge, and there was no time for Guardala to get any counsel in that time.

This next court date should show the future direction of the case and whether it is going to be a fight or a sentence. I believe the prosecution would like to see it go to trial since the case is so strong and Guardala's guilt is so evident.

Dave Guardala's Future

I'm not worried about it either way. I am confident of Guardala's guilt since I was ripped off. I am pleased with investigators efforts to prepare the case and feel confident about their abilities to present that case in court. I am happy that Guardala was apprehended, extradited back to the US, and held without bail thus far. I know from many of the victims, that there is a ton of evidence in this case; and all indicators say Guardala should be living rent free, as a prisoner and resident of the Federal Prison system soon.

The beauty of this, for me, is the timing. It was February 2007 that I first went online and he could well be starting his prison sentence on that anniversary. My efforts online have been tenuous and frustrating at times, but sites all over the world have carried the Guardala warnings and my personal counters for Guardala.net and DaveGuardala.net list roughly over 15,000 visitors in less than a year. Some creative math, counting views on blogs and sites around the world place the page view count at well over 100,000 pages read regarding Dave Guardala Scams and Fraud!

Thanks again to the many individuals that did believe my story and partnered with me to get the warning out that Guardala was still out there! For many, this was a very controversial topic that brought a lot of division thru the ranks. Thanks for the many that possibly experienced some hardship due to this support! I so appreciate your part in getting this wolf out of our saxophone community backyard.

To the other victims - GREAT WORK! You have gone thru some really difficult stuff and are stronger from it! You stopped a bad guy from hurting more and more and more people. Thanks So Much!!!

Guardala Pleads NOT GUILTY!

Dave Guardala NEWS - Guardala UPDATE

It's official - Dave Guardala Pleaded NOT GUILTY to charges today in Federal Court in New York according to Randy Kessler, writer for NewsDay.com.

According to the article, Dave Guardala was at arraignment proceedings this morning to hear 10 counts of alleged fraud read against him with federal public defender Randi Chavis by his side. The Judge in this case is listed as U.S. Magistrate Arlene Lindsey, and proceedings were held at United States District Court, Eastern District of New York.

On the court schedule, Senior Judge Thomas Platt was scheduled in Courtroom 1040 at 11AM Eastern, for Criminal Cause for Arraignment, but it appears from this article by Kessler that the Judge today was U.S. Magistrate Arlene Lindsey.

Other interesting note was the last line of the article. To this date, little has been said or projected about a possible sentence in this case if Guardala is found guilty. Kessler's closing statement was Dave Guardala could get up to 30 years in prison if convicted.

DAVE GUARDALA in the US

It is true. Dave Guardala will be flown in this weekend to meet a public defender and judge on Monday morning in New York!! The real Dave Guardala - the Mouthpiece Maker, Sax Guru, saxophone mouthpiece king, maker of sax products to the stars - Dave Guardala is on his way to the US to face a 12 count indictment on fraud, scamming many past friends and associates out of 660,000 dollars, as federal charges read.

Those of us involved in this case as victims know the amount is much larger than that, but this is how the Federal Indictment reads.

I got a call from a fellow victim, early this morning, and then a call from an investigator working this case right after, confirming that Dave Guardala was being transfered to the US this weekend. I talked again to my friend who had spoke at length with investigators earlier this morning and it is the real deal!

The victims I have reached are very pleased with the news. Aside from going back in time to avoid business dealing with Guardala in the first place, the next biggest comment has been, "At least He's not just getting away with this!" Federal Charges are serious! If found guilty Dave Guardala will serve the majority of his sentence in a federal prison. HE than can expect Civil actions once released by victims, and there are all the other non-US victims that well have a case and jail cell awaiting once he is done serving time here - if and when convicted or plea of guilty is heard.

I'm not a legal guy and have the same access to web info as anybody here. My comments are my educated guesses.

The NEW IS - Dave Guardala will be here in a few days and before a judge.
